Customers agree to Appalachian Press’s terms and conditions by the act of submitting orders via either Appalachian Press’s online ordering site, instructions containing in an email message, or in person at the Appalachian Press in Westfield, MA.
Production begins on an order when Appalachian Press receives print ready files and payment is processed.
Quotations and online pricing
Pricing on Appalachian Press’s online ordering site are subject to change without notice. Written estimates are valid for 30 days and are subject to revision based on review of customer supplied digital files.
Proofs are not available, other than PDF soft proofs provided when designing online. We do not proof submitted projects, however, sometimes errors are noticed. We make no guarantee that errors will be noticed. If errors are noticed in your file, Appalachian Press will alert you promptly. You may either submit corrected files or we can correct the files. Additional charge will apply. The customer is fully responsible for submitting files that are proofed and ready to print. Please see File Preparation Guidelines section elsewhere on this website for assistance in making suitable files.
We cannot be responsible for the following
- Spelling, punctuation, or grammatical errors made by you.
- Inferior quality or low-resolution of uploaded images.
- Design errors or color selection errors introduced in the artwork file creation process submitted by you.
- Errors in user-selected options such product type, size, finishing options, or quantity.
- Incorrect dimensions, image orientation, or file submission in accordance with Appalachian Press specifications.
- Delivery delays due to improperly prepared files.
- Duplicate orders by the customer.
- Incorrect file layout for folding, scoring, hole drilling, die cutting or other custom services.
Content and specification changes
Requests for changes in the content or specifications of a printed piece must be submitted in writing (email). Applicable charges based on Appalachian Press’s current rates will be assessed to make requested author’s alterations or design modifications.
Acceptance of orders
We reserve the right to refuse any order for any reason. Typically, the only reason an order might be rejected is if it contains highly distasteful, pornographic or objectionable subject matter or is known to be illegal.
Copyright compliance and indemnification
Appalachian Press assumes no liability for any damages resulting from unknowing violations of copyright laws or the illegal use of trade names or slogans. By submitting their order, customers acknowledge that they own the rights or have obtained permission to reproduce the materials being requested.
Appalachian Press’s policy is to produce the exact quantity ordered. Generally, there is a very slight overrun included at no charge. In the rare event of a significant underun, Appalachian Press reserves the right to deliver up to an industry standard of 10% short of the order quantity. In such cases, only the amount actually delivered will be billed and any overpayment will be refunded.
Production turnaround times do not include shipping transit time. Turnaround times start upon our receipt of final files, payment and review of files and end when the job is shipped. Keep in mind that only standard business days are counted as production days.
Appalachian Press reserves the right to contract with another vendor to perform any of the work required for an order.
Appalachian Press may use products produced for customers as samples for marketing purposes, unless notified in writing by the customer that it does not have permission to do so.
If an order is canceled, customers are responsible for and obliged to pay for any costs incurred up to the point of cancellation.
Delays and/or damage incurred during shipping are not Appalachian Press’s responsibility. The customer assumes title for finished work at the time it passes to the carrier for shipping.
Credit card charges will appear on statements as “Appalachian Press.”
All Massachusetts orders are subject to applicable sales taxes, currently 6.25%.
Warranty and limit of liability
Appalachian Press guarantees all orders to be free of defects in workmanship. Any performance short of commonly accepted industry standards will be reprinted or refunded, at Appalachian Press’s discretion, provided claims are submitted according to the terms described herein.
Appalachian Press’s liability is limited to the stated sell price to the customer for any defective goods. In no event shall liability include special, consequential, incidental, indirect or similar damages, including without limit, lost profits. This constitutes the limit of warranty, regardless of verbal or written statements made by Appalachian Press agents.
Customers must make any claims for damages, defects or shortages in writing within 5 business days of receipt of finished work. The absence of any such claim implies the customer’s acceptance of completed work and acknowledgement of Appalachian Press’s full satisfaction of all terms, conditions and specifications.
Disputes and venue
Should there be a need for legal proceedings, the venue for any such dispute will be Westfield, MA.
Appalachian Press does not share any information it collects from order processing or general inquiries. Use of information is limited to purposes of customer contact, billing and shipping. Appalachian Press does not store credit card information. Respecting the privacy of personal and company information is a fundamental Appalachian Press policy. There are no circumstances under which customer information will be sold or used for any other purpose than the internal processing of orders.
Terms subject to changes
Appalachian Press may elect to change all or part of this policy at any time. The posting of such changes will cause them to be effective immediately, unless expressly stated otherwise. Effective date of these Terms and Conditions is March 1, 2019.
